These Terms and Conditions (“Agreement”) govern the services provided by The Portraits Lounge (“we,” “us,” or “our”) to clients (“you” or “Client”) who engage us for luxury portrait services at private or public events. By booking our services, you agree to the terms outlined below.


1. Booking & Reservation

  • A signed agreement and a non-refundable retainer fee (typically 50% of the total) are required to secure your date.

  • Your event date is not considered booked until both the signed agreement and retainer have been received.

  • Final payment is due no later than 7 days prior to the event, unless otherwise agreed in writing.


2. Services Provided

  • We offer on-location portrait photography featuring either a standard black/white background (“Portraits Booth”) or a fully custom-designed set (“Portraits Lounge”).

  • Our standard package includes a 3-hour portrait session, with setup and breakdown time scheduled separately.

  • On-site photo printing and custom framing are available as add-on services.

  • Services rendered will be outlined in your specific booking proposal or contract.


3. Travel & Accommodations

  • Events outside a 30-mile radius of Denver, Colorado may be subject to additional travel fees, including mileage, lodging, and per diem costs as applicable.

  • For events requiring overnight stays or extensive travel, the client is responsible for reasonable accommodation expenses for the photography team.


4. Cancellation & Rescheduling

  • The initial retainer is non-refundable.

  • Cancellations made less than 30 days before the event will result in forfeiture of all payments made.

  • Rescheduling is subject to availability and must be requested in writing.

  • If we are unable to accommodate a rescheduled date, the cancellation policy will apply.


5. Image Use & Copyright

  • All images taken by The Portraits Lounge are the intellectual property of Studio JK Photography and are protected under U.S. copyright law.

  • We reserve the right to use selected images for promotional purposes, including but not limited to our website, social media, marketing materials, and publications, unless otherwise agreed in writing.

  • If you or your guests wish to opt out of public image use, please notify us prior to the event in writing.


6. Guest Participation & Consent

  • By participating in a session during an event, guests implicitly grant consent to be photographed and to allow reasonable use of their image for promotional purposes unless an opt-out request is submitted.

  • All event galleries are password protected, and access is provided only to the host or designated contact.


7. Delivery of Images

  • Images are typically delivered within 2–3 weeks of the event via a secure, online gallery.

  • High-resolution files are included unless otherwise specified.

  • On-site prints and framing options may vary depending on package and event logistics.


8. Client Responsibilities

  • The client agrees to provide sufficient space, access to power outlets, and an indoor or protected location (in case of inclement weather) for setup.

  • The client is responsible for informing guests that photography will be taking place.

  • Delays caused by venue access, guest availability, or event timing may reduce the number of portraits captured and will not warrant refunds.


9. Limitation of Liability

  • While we take all necessary precautions, The Portraits Lounge shall not be held liable for any failure to perform its obligations due to unforeseen circumstances beyond our control, including but not limited to weather, illness, or equipment failure.

  • In the unlikely event of complete service failure or cancellation by us, liability is limited to the return of all payments received.


10. Force Majeure

  • Neither party shall be liable for failure to perform its obligations due to events beyond reasonable control including natural disasters, government restrictions, pandemics, or transportation interruptions.


11. Governing Law

  • This Agreement shall be governed by the laws of the State of Colorado. Any legal action relating to this Agreement shall be filed in the applicable courts of Denver County, Colorado.
